while i agree with your top 5 especially #3 the SEO aspect, it entirely depends on the purpose of the website and the niche.

For example look at any high-end designer company, the impressive nature of flash is going to raise their profile more than a static page full of links.

Anyone who can afford to buy a Armani Suit, is not going to be on dial-up and in that case Flash will ’sell’ their suits more effectively than a css page.

I use those with clients. I have another one which I have started to use lately and its working. I sell B2B website. Sites should be simple with an easy flow of how a person should work the site. As soon as you add animation you break the chain of thought. So instead of looking at the key heading they land up looking at the animation, it breaks the visitors though pattern

A quick note on the 40%, here in South Africa, that is most probably much higher and our fast connections are 512k (64k), add 10 users to the network and you might as well be on a dial up.

Flash sucks.

I have to agree with you. I hate flash websites. They have too many bells and whistles, too much going on, they take too long to load.

The trend has moved to simpler sites.

I agree with that. I use FlashBlock (firefox plugin) to block flash

Thanks for mentioning Photrade (which is how I found your post). I fully agree with all of the risks to using flash. We actually have some SEO issues caused by out use of Java.

Even tho there are methods to optimize flash sites for search engines yet it is something limited as to what can be done. Your points are valid (neither I have ever liked flash sites much, maybe just some small parts of flash).

As far as it regards this site it loads just great (tho i am on DSL)
